Sep. 11 -- An apparent fight over an all-terrain vehicle sparked a fatal shooting in Southeast Albuquerque last month.

Guillermo Munoz Delgado, 29, of Albuquerque, is charged with an open count of murder, three counts of kidnapping, three counts of aggravated assault and tampering with evidence in the Aug. 24 incident.

Munoz Delgado was arrested on Sept. 5, after allegedly being found with fentanyl and methamphetamine. He has been behind bars at the Metropolitan Detention Center since. Munoz Delgado is not yet being represented by an attorney.

According to a criminal complaint filed at Metropolitan Court, witnesses identified Munoz Delgado in a photo lineup.

At about 6:45 a.m. on Sept. 5, the Albuquerque Police Department responded to a call of a homicide in the 1000 block of Florida SE, near Wilson Middle School.

According to the complaint, when officers arrived, they saw a man -- later identified as Christian Aragon, 19 -- with a gunshot wound to his chest. He was alert and talking before being taken to a hospital, where he died.

The complaint states that Aragon was with multiple people at a smoke shop in the 100 block of San Mateo, near Central, where he test-drove an all-terrain vehicle. Witnesses said two people became agitated because of the amount of time Aragon was on the ATV and they found him in the 1000 block of Florida after the ATV stalled.

Police said a man known as "Gucci" -- later identified as Munoz Delgado -- pointed a gun at and got into a fight with Aragon's friend. Witnesses told police the friend asked Aragon for help when Aragon ran toward them, pulled out a firearm and started shooting.

The complaint states multiple bullets were fired between Aragon and Munoz-Delgado, including one that hit Aragon's chest. Police said a witness told them Aragon called 911 and said, "Please, I don't want to die," before collapsing.
