PRESTON, Minn. - Search warrants in a deadly Fillmore County buggy crash are being called into question by the defense team for Samantha Petersen.
Petersen is facing 21 felony charges in connection with the crash that killed two children and injured two others. She appeared in court on Monday.
Court documents say she was driving while high on methamphetamines when she hit an Amish buggy before later switching spots with her twin sister Sara, to avoid prison time.
During the omnibus hearing, Petersen's defense lawyers called into question three search warrants.
First, the team believes the evidence from the blood and urine test should be thrown out because the scope of the test went beyond methamphetamines.
The defense also questioned the search warrant for the sisters' phones.
The team also argued the search warrant for a recorded conversation between the two sisters should not be admitted because the accused did not give their consent.
During the hearing, the prosecution called Fillmore County Deputy Don Kullot to testify.
He recorded the Petersen sister's conversation back in September of 2023. That's when Kullot said he took out his mini audio recorder in front of Sara to turn it on before he escorted her to the squad truck and placed the recorder in the cup holder between them.
When he left the car, Kullot said he kept the recorder on because he intended to continue Sara's interview after talking with his colleague. When he came back, he saw the window rolled down and Samantha taking to Sara. He believes Sara rolled it down.
No date has been set for Samantha's next court appearance.
Sarah Petersen is schedule to appear in court on October 21.
